The rules for using warhorntactical.com and buying Warhorn gear, written in plain English. Please read Sections 8 through 12 and 16 through 18 carefully. They cover defect claims, safety, our liability, and how disputes are resolved, including binding arbitration.
These Terms & Conditions (the "Terms") are a binding agreement between you and Warhorn Tactical LLC, a North Carolina limited liability company ("Warhorn Tactical," "Warhorn," "we," "us," or "our"). They cover your use of warhorntactical.com and our online store (the "Site") and every purchase you make from us. Our Privacy Policy is part of these Terms.
IMPORTANT: SECTION 18 REQUIRES MOST DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT WAIVES CLASS ACTIONS. YOU CAN OPT OUT OF ARBITRATION WITHIN 30 DAYS, AS EXPLAINED IN SECTION 18.
1. Accepting These Terms; Eligibility
In short: Using the site or buying from us means you agree to these Terms. You must be 18 or older to buy anything.
By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
You must be at least 18 years old to buy from us. This applies to all products, including apparel. By placing an order, you confirm that you are 18 or older (or the age of majority where you live, if higher) and legally able to enter into a contract. Visitors under 18 may browse only with the involvement of a parent or guardian, and the Site is not directed to children under 13. We may cancel any order we reasonably believe was placed by someone under 18.
2. Who We Are and What We Sell
In short: We sell apparel and range accessories, only on warhorntactical.com. We don't sell firearms or ammunition.
Warhorn Tactical is a veteran-owned brand based in Aberdeen, North Carolina. Built for the Prepared. We sell tactical apparel (currently T-shirts and other apparel) and, as they are released, shooting-range accessories such as a shooting table and table attachments.
We do not sell firearms, ammunition, firearm frames or receivers, or other items regulated by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Our shooting accessories are range equipment. They are not firearms or firearm parts, and they are not safety devices.
We sell only through warhorntactical.com. We do not sell on Amazon, eBay, or other third-party marketplaces. Products bought from anyone else are not covered by our Limited Warranty unless you can show they were originally purchased from us.
We try to describe and photograph our products accurately. Colors can look different on different screens, and hand-finished or printed items can vary slightly. That kind of normal variation is not a defect.
3. Our Store Platform
In short: Our current or future e-commerce platform (such as Shopify) will run our store and checkout, but your purchase contract is with Warhorn Tactical LLC.
Nothing is for sale on the Site yet. When online sales open, our store will be hosted on our current or future e-commerce platform (such as Shopify), and payments will be processed through that platform's payment service (such as Shopify Payments) and the other payment methods shown at checkout. Your purchase contract is with Warhorn Tactical LLC, not the platform. The platform's processing of your information is covered by our Privacy Policy and by the platform's own privacy policy (for Shopify, https://www.shopify.com/legal/privacy). The Site and our contact form are hosted by Netlify, Inc., and our email list is managed by Klaviyo, Inc.; these Terms apply to all pages of the Site.
4. Accounts
In short: Keep your login safe, and tell us if something looks wrong. Guest checkout is fine.
If you create an account, keep your login information confidential and tell us right away if you think someone else has used your account. You are responsible for activity on your account that you authorize or that results from your failure to protect your login. We are not responsible for activity caused by our own errors or security failures. Creating an account is optional and available only if we offer accounts in our store; you can always check out as a guest.
5. Orders, Pricing, and Cancellations
In short: We confirm your order when it ships. If we cancel or make a pricing error, you get a full refund, and we'll never charge you more than you approved.
- Your order is an offer. A contract forms when we ship your order or send a shipping confirmation. An order-received email only confirms that we got your order.
- We may decline or limit orders, for example for suspected fraud, resale, an age-eligibility concern, a destination we cannot lawfully ship to, or stock limits. If we cancel an order after you have paid, we will refund you in full.
- Pricing errors. If a product is listed at an obviously wrong price or with wrong information, we may cancel the order and refund you in full. Alternatively, we will contact you to offer the correct price, and the order will go ahead only if you agree to it. We will never charge you more than the total you approved at checkout.
- Cancellations. You may cancel an order for a full refund by emailing info@warhorntactical.com at any time before we mark it as shipped. Because we try to ship quickly, we cannot guarantee that a cancellation request will reach us in time; once an order has shipped it can no longer be canceled, and the defect-only return policy in Section 8 applies.
- Promotions and discount codes are subject to the terms stated with the offer, cannot be combined unless the offer says so, and cannot be applied to past orders.
- Pre-orders (if offered): we will show an estimated ship date. If we cannot ship within 30 days of that date, we will tell you, and you may cancel for a full refund, consistent with the FTC Mail, Internet, or Telephone Order Merchandise Rule.
6. Payment and Sales Tax
In short: Prices are in U.S. dollars, and payments run through our e-commerce platform (such as Shopify). We collect North Carolina sales tax, and other states' tax where required.
Prices are in U.S. dollars. We accept the payment methods shown at checkout, processed through our e-commerce platform's payment service (such as Shopify Payments) and its supported gateways. You confirm that you are authorized to use the payment method you provide. Payment is charged when you place your order.
Sales tax. We collect North Carolina sales tax (state and applicable local rates, such as Moore County) on orders shipped to North Carolina addresses, and we collect sales tax for other states where we are required to. The tax is calculated at checkout from your shipping address. Any tax shown before checkout is an estimate.
7. Shipping, Delivery, and International Orders
In short: We ship within the U.S. and internationally, and you pay the shipping charges shown at checkout. Lost or damaged packages are on us if you report them within 30 days, including any return shipping. International buyers pay duties and taxes and are responsible for import rules.
- Where we ship: the United States (including APO/FPO/DPO addresses and U.S. territories) and international destinations offered at checkout, except places we cannot lawfully ship to (see Section 11).
- Processing time: orders usually ship within 1 to 3 business days after payment. Delivery dates from carriers are estimates, not guarantees.
- Shipping charges: you pay the shipping charges for your order, which are shown at checkout before you pay.
- Risk of loss: title and risk of loss pass to you when the carrier delivers the package to your shipping address. If a package is lost in transit, or arrives damaged, contact us within 30 days of the delivery date (or of the expected delivery date, for lost packages), and we will work with the carrier and replace or refund the item. If we need a damaged item back, we pay return shipping (see Section 8).
- Address accuracy: please double-check your address. If a package is returned because the address was wrong or incomplete, we will reship it once you pay the added shipping cost, or refund the product price.
International orders
- You are the importer of record. International customers are responsible for all import duties, taxes (such as VAT or GST), customs fees, and carrier brokerage charges. These are not included at checkout unless the checkout says otherwise.
- Customs delays and seizures: we are not responsible for delays caused by customs, or for items held, seized, or destroyed by customs authorities. Refused or abandoned international shipments are not refunded for shipping, duties, or return-freight costs. Any refund of the product price is at our discretion once we receive the item back.
- Import legality is your responsibility. Some countries restrict tactical clothing, military-style items, or shooting accessories. Before ordering, you must confirm that you can lawfully import and possess the products where you live.
8. Returns and Refunds: Defects Only
In short: All sales are final, except for defects. Report a manufacturing defect within 30 days of delivery, and we'll refund, repair, or replace it, at our option. For defect claims you pay to ship the item back to us; we pay to ship a repaired or replacement item to you. If we sent the wrong item or it was damaged in shipping, we pay return shipping. Email your order number and photos to info@warhorntactical.com.
ALL SALES ARE FINAL EXCEPT AS PROVIDED IN THIS SECTION 8 AND IN THE LIMITED WARRANTY IN SECTION 9. WE DO NOT ACCEPT RETURNS OR EXCHANGES FOR CHANGE OF MIND, SIZING, FIT, COLOR, OR STYLE. IF YOU HAVE QUESTIONS ABOUT SIZING, CONTACT US AT INFO@WARHORNTACTICAL.COM BEFORE YOU ORDER.
Final sale never takes away your right to a product that is free from manufacturing defects and that matches what you ordered. Here is how that works:

How to make a claim
- Email info@warhorntactical.com within the time limit above. Include your order number, a short description of the problem, and clear photos that show the defect (and the label or tag, for apparel).
- We will review your claim and reply, usually within 2 business days. We may ask for more photos, or ask you to send the item back so we can inspect it. Please do not send anything back until we give you return instructions.
- If we need the item back, we will send return instructions. For defect and warranty claims, you are responsible for the cost of shipping the item to us, including under an approved claim. Please pack the item securely and use a trackable shipping method; we are not responsible for items lost or damaged on the way back to us. Exception: if we sent the wrong item, or the item was damaged in shipping, and you report it within 30 days of delivery, we pay return shipping by providing a prepaid return label or reimbursing your reasonable return shipping cost. In every case, we cover the cost of shipping a repaired, replacement, or correct item to you.
- Once the claim is approved (and, if requested, the item is received), we will ship the repaired or replacement item at our cost, or issue the refund. Refunds go to your original payment method within 10 business days of approval. For defect and warranty claims, refunds cover the product's purchase price; original shipping charges and return shipping costs are not refunded. If we refund a wrong item or an item damaged in shipping, the refund also includes the original shipping charge for that item. Your bank may take a few more days to post the refund.
Making a claim does not affect any rights you have under the law, including North Carolina law, that cannot be waived by contract.
9. Limited Warranty and Warranty Disclaimer
In short: Every product has a 30-day Limited Warranty against manufacturing defects. You pay to ship a product back to us for a warranty claim; we pay to ship the repaired or replacement item to you. Beyond that, implied warranties are limited as far as the law allows, but you keep any rights that can't be waived.
Our 30-day Limited Warranty
Warhorn Tactical LLC warrants to the original retail purchaser that each product bought from warhorntactical.com will be free from defects in materials and workmanship for 30 days from the delivery date (the "Warranty Period"). If a covered defect is reported during the Warranty Period using the process in Section 8, we will, at our option, refund the purchase price, repair the product, or replace it. You are responsible for the cost of shipping the product to us for a warranty claim; we will pay the cost of shipping a repaired or replacement product back to you. This is a "Limited Warranty" under the federal Magnuson-Moss Warranty Act.
Not covered: normal wear and tear; fading, shrinkage, or damage caused by not following the care label; damage from misuse, abuse, accidents, neglect, or improper assembly or installation; modifications or repairs not made by us; using a product beyond its stated limits (such as a shooting table's load rating) or for a purpose it was not designed for; damage caused by firearms, ammunition, gunfire, muzzle blast, hot brass, or projectiles; minor cosmetic variations that do not affect function; and products not bought from warhorntactical.com.
TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE 30-DAY WARRANTY PERIOD. EXCEPT FOR THIS LIMITED WARRANTY AND ANY IMPLIED WARRANTIES THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, WARHORN MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, ABOUT ITS PRODUCTS. THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL WARRANTIES ABOUT THE SITE, INCLUDING WARRANTIES OF ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
THE REMEDIES IN SECTIONS 8 AND 9 ARE YOUR EXCLUSIVE REMEDIES FOR PRODUCT DEFECTS, EXCEPT AS PROVIDED IN SECTION 16 (WHICH DOES NOT LIMIT CLAIMS FOR PERSONAL INJURY OR PROPERTY DAMAGE CAUSED BY A DEFECTIVE PRODUCT) AND EXCEPT AS APPLICABLE LAW PROVIDES OTHERWISE.
Some states do not allow limits on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.
10. Shooting Accessories: Safe Use and Assumption of Risk
In short: Shooting is dangerous. Follow the instructions, the load ratings, the range rules, and the firearm-safety rules. You accept the risks that come with shooting, but not the risk of a defect in our product.
Shooting is inherently dangerous. Our shooting table and attachments are designed to make range time more organized and comfortable. They do not make shooting safe, and they do not replace safe firearm handling, training, and judgment. Before using any Warhorn shooting accessory, you agree to:
- read and follow all product instructions, labels, warnings, and load or weight ratings, where provided with the product, on its packaging, or on our website;
- inspect the product before each use, and stop using it if it is damaged, loose, cracked, or missing parts;
- set it up only on stable, level ground, and make sure it is secure before placing firearms, ammunition, or equipment on it;
- follow the universal firearm-safety rules at all times: treat every firearm as loaded, never point the muzzle at anything you are not willing to destroy, keep your finger off the trigger until ready to fire, and be sure of your target and what is beyond it;
- wear appropriate eye and ear protection, and follow all range rules and range-officer instructions;
- never use the product as a shooting target, as a barrier, or as protection from projectiles;
- not modify the product, and not use it with devices or loads it was not designed for; and
- keep firearms and ammunition secured and out of reach of children and unauthorized persons.
Assumption of risk. You understand that shooting activities involve risks of serious injury, death, and property damage. Those risks come from firearms, ammunition, ricochets, the conduct of other shooters, range conditions, and weather, among other things. Warhorn does not control any of them. To the fullest extent permitted by law, you voluntarily assume those inherent risks. This does not waive any claim that an injury was caused by a defect in a Warhorn product, or by Warhorn's own negligence where such a waiver is not allowed by law.
Information only. Videos, social media posts (including on TikTok, YouTube, and Instagram), and other content from Warhorn are for general information and entertainment. They are not professional firearms training or legal advice. Seek qualified instruction before shooting.
11. Compliance with Laws and Export Controls
In short: Follow the laws where you live. We follow U.S. export and sanctions rules and won't ship where it's illegal.
Local laws. Laws on shooting equipment, range use, and tactical gear vary by city, county, state, and country. You are responsible for knowing and following the laws that apply to your purchase, possession, transport, and use of our products. We may refuse to ship to any destination where we believe a sale would be unlawful.
Export controls and sanctions. Our products are shipped in compliance with U.S. export laws, including the Export Administration Regulations, and U.S. economic sanctions administered by the Treasury Department's Office of Foreign Assets Control (OFAC). Based on their nature, we do not expect our current apparel and range accessories to be defense articles under the International Traffic in Arms Regulations (ITAR). If any future product were export-controlled, we would say so on its product page and limit shipping as the law requires. We do not ship to countries or regions subject to comprehensive U.S. sanctions (as OFAC identifies them from time to time), or to anyone on a U.S. government restricted-party list. By ordering, you confirm that you are not such a person and that you will not export or re-export products in violation of U.S. law.
California Proposition 65. Where a California Proposition 65 warning is required by law for a product, we will provide it before purchase, such as on the product page, at checkout, or on the product label or packaging.
12. Intellectual Property
In short: Our name, logo, slogan, and designs are ours. Share our links freely, but don't copy our gear or our marks.
Warhorn Tactical™, the Warhorn Tactical name and logos, the slogan "Built for the Prepared," product designs, graphics, photos, videos, and Site content belong to Warhorn Tactical LLC or its licensors and are protected by trademark, copyright, and other laws. You may view and share Site content for personal, non-commercial purposes, for example by sharing a product link. You may not copy, sell, or use our marks or designs, including on your own merchandise, without our written permission.
Copyright complaints. If you believe content on the Site infringes your copyright, send a notice that meets the requirements of the Digital Millennium Copyright Act (17 U.S.C. 512(c)(3)) to info@warhorntactical.com or to our mailing address.
13. Reviews, Photos, and Feedback
In short: Honest reviews are always welcome, good or bad. If you share content with us and we feature it, you still own it.
We welcome honest reviews, positive or negative. Nothing in these Terms limits your right to post an honest review or opinion about us or our products, consistent with the federal Consumer Review Fairness Act. We will not penalize you for an honest review. If we offer product reviews, they may be collected and displayed through third-party review tools we may use.
If you submit a review, photo, or other content to the Site, or tag us on social media and then agree in writing (including by reply message) that we may feature it, you give us a non-exclusive, royalty-free, worldwide license to display and share that content, with credit where practical, in connection with Warhorn and its products. You keep ownership of your content. We may remove content that is unlawful, infringes someone's rights, contains personal information of others, is spam, or is not about our products. We do not edit reviews to change their meaning.
If you send us product ideas or suggestions, you agree that we may use them without obligation to you, unless we have a separate written agreement.
14. Acceptable Use
In short: No fraud, bots, hacking, or harassment.
When using the Site, you agree not to:
- break any law or use the Site for fraud, including unauthorized payments or false defect claims;
- buy products for unauthorized commercial resale, or use bots to buy limited releases;
- hack, scrape, overload, or interfere with the Site or its security, or introduce malware;
- impersonate anyone, or misrepresent your age or identity; or
- harass our staff or other customers.
We may suspend access or cancel orders, with a refund of any amounts paid for unshipped items, if you violate this section.
15. Third-Party Links and Services
In short: Other companies' sites and services have their own rules.
The Site may link to or embed services run by others, such as our e-commerce platform (for example, Shopify), Klaviyo, payment providers, shipping carriers, and TikTok, YouTube, or Instagram. We are not responsible for their content, products, or policies. Your use of those services is governed by their terms.
16. Limitation of Liability
In short: If something goes wrong, our liability is generally capped at what you paid. That cap never applies to injuries caused by a defective product, our negligence, fraud, or rights that the law protects.
TO THE FULLEST EXTENT PERMITTED BY LAW, WARHORN TACTICAL LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF USE, ARISING OUT OF THE SITE, THESE TERMS, OR ANY PRODUCT. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SITE, THESE TERMS, OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT OR ORDER THAT GAVE RISE TO THE CLAIM.
THESE LIMITATIONS DO NOT APPLY TO (A) DEATH, PERSONAL INJURY, OR DAMAGE TO PROPERTY (OTHER THAN THE PRODUCT ITSELF) CAUSED BY A DEFECTIVE WARHORN PRODUCT OR BY OUR NEGLIGENCE; (B) OUR FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT; (C) RIGHTS AND REMEDIES UNDER THE NORTH CAROLINA UNFAIR AND DECEPTIVE TRADE PRACTICES ACT (N.C. GEN. STAT. 75-1.1 ET SEQ.) OR OTHER CONSUMER-PROTECTION LAWS THAT CANNOT BE WAIVED; OR (D) ANY OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
17. Your Responsibility for Misuse (Indemnification)
In short: If you misuse a product or break the law and someone sues us because of it, you cover the reasonable costs. This doesn't apply to our defects or our mistakes.
To the extent permitted by law, you agree to reimburse Warhorn for reasonable losses and costs, including reasonable attorneys' fees, from third-party claims that result from (a) your misuse of a product, including use contrary to Section 10; (b) your violation of law, including import, export, or local laws; or (c) your material breach of these Terms. This does not apply to claims caused by a product defect or by our own negligence or misconduct. We will notify you promptly of any such claim, and we will not settle it in a way that imposes obligations on you without your consent.
18. Disputes: Informal Resolution, Arbitration, and Class-Action Waiver
In short: Contact us first. If we still can't settle it, it goes to individual arbitration, where Warhorn pays most of the costs, or to small claims court. You can opt out within 30 days.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS. UNLESS YOU OPT OUT, YOU AND WARHORN AGREE TO RESOLVE DISPUTES BY BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND YOU AND WARHORN EACH GIVE UP THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
(a) Talk to us first. Most problems can be fixed with an email. Before starting arbitration or a lawsuit, the person bringing the claim must send a written notice describing the claim and the relief requested: to Warhorn at info@warhorntactical.com and P.O. Box 140, Aberdeen, NC 28315, or to you at the contact information we have on file. Both sides will try in good faith to resolve the dispute for 30 days. Statutes of limitation are paused during this 30-day period.
(b) Agreement to arbitrate. If the dispute is not resolved, any claim between you and Warhorn arising out of or relating to the Site, these Terms, the Privacy Policy, or any product or purchase (a "Claim") will be resolved by binding arbitration on an individual basis. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (https://www.adr.org/consumer) before a single arbitrator. The Federal Arbitration Act governs this agreement to arbitrate. To the extent the Federal Arbitration Act does not apply, the North Carolina Revised Uniform Arbitration Act (N.C. Gen. Stat. 1-569.1 et seq.) governs.
(c) Location and format. You may choose to hold the arbitration by video, by phone, or on written submissions, or in person in Moore County, North Carolina, or in the county where you live.
(d) Costs. Your share of AAA filing fees will not exceed the amount allowed by the AAA Consumer Arbitration Rules. Warhorn will pay the rest of the AAA administrative fees and the arbitrator's compensation. For Claims under $10,000 that are not found to be frivolous, Warhorn will also reimburse your filing fee. Each side pays its own attorneys' fees, unless the arbitrator awards fees as allowed by law, including under N.C. Gen. Stat. 75-16.1. Warhorn will not seek its attorneys' fees from you unless the arbitrator finds your Claim frivolous.
(e) Same remedies as court. The arbitrator may award the same individual relief a court could award, including statutory damages, treble damages, and attorneys' fees where the law allows. The arbitrator must follow these Terms and applicable law.
(f) Exceptions. Either side may instead bring an individual claim in small claims court (in North Carolina, magistrate's court) if the claim qualifies and stays there. Either side may also go to court to stop infringement or misuse of intellectual property.
(G) CLASS-ACTION WAIVER. YOU AND WARHORN MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OF MORE THAN ONE PERSON. IF A COURT DECIDES THAT THIS CLASS-ACTION WAIVER CANNOT BE ENFORCED FOR A PARTICULAR CLAIM OR REMEDY, THAT CLAIM OR REMEDY (AND ONLY THAT ONE) WILL BE HEARD IN COURT UNDER SECTION 19, NOT IN ARBITRATION. A COURT, NOT AN ARBITRATOR, DECIDES WHETHER THIS CLASS-ACTION WAIVER IS ENFORCEABLE.
(h) 30-day right to opt out. You can opt out of this arbitration agreement by sending a notice within 30 days after you first accept these Terms (for example, by placing your first order). Email info@warhorntactical.com with the subject line "Arbitration Opt-Out," or mail a notice to Warhorn Tactical LLC, Attn: Arbitration Opt-Out, P.O. Box 140, Aberdeen, NC 28315. Include your name, address, email, order number (if any), and a clear statement that you are opting out of arbitration. Opting out will not affect anything else about your relationship with us, including your warranty. If you opt out, Claims will be resolved in court under Section 19.
(i) Changes. If we make a material change to this Section 18, the change will not apply to a Claim that you notified us about before the change, and you may reject the change by emailing us within 30 days after it is posted.
(j) Severability. If any part of this Section 18 is found unenforceable, other than the class-action waiver (which is addressed in paragraph (g)), that part will be severed, and the rest of the arbitration agreement will still apply.
19. Governing Law and Venue
In short: North Carolina law applies, and court cases are heard in Moore County or the Middle District of North Carolina.
These Terms and any Claim are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules, and by applicable federal law. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any court proceeding that is permitted under these Terms (for example, after an arbitration opt-out, under an exception in Section 18(f), or to enforce or vacate an arbitration award) must be brought in the state courts located in Moore County, North Carolina, or in the United States District Court for the Middle District of North Carolina. You and Warhorn consent to personal jurisdiction and venue there. If you are a consumer, nothing in this section takes away any right you have under the law of your home state to bring a claim where you live. Nothing in these Terms shortens any time limit for bringing a claim that is set by law.
20. Electronic Communications and Text Message Terms
In short: Marketing emails and texts go only to people who opted in. Reply STOP to texts or click unsubscribe in any email, and you're out. You never have to sign up to buy from us.
You agree that we may give you notices, receipts, and disclosures electronically, by email or on the Site, and that electronic communications satisfy any requirement that they be in writing.
Email marketing. If you sign up, we will send newsletters and offers through Klaviyo or similar email service providers (such as Shopify Email). Every marketing email includes an unsubscribe link, which we honor promptly, as required by the CAN-SPAM Act.
Text message (SMS/MMS) program. If you opt in, for example by checking the box at checkout or texting a keyword, you agree to receive recurring automated marketing and cart-reminder text messages from Warhorn Tactical at the mobile number you provide. Messages are sent through SMS service providers such as Klaviyo, Shopify Messaging, or similar platforms. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time; you may receive one final confirmation message. Reply HELP for help, or contact info@warhorntactical.com or (910) 699-3848. Carriers are not liable for delayed or undelivered messages. You confirm that you are the account holder, or that you have the account holder's permission, for the number you enroll. We will not send marketing texts before 8 a.m. or after 9 p.m. in your local time. Your mobile number and opt-in data will not be sold or shared with third parties for their own marketing. 21. Changes to These Terms
In short: When we update these Terms, we change the date at the top. Updates never apply to orders you've already placed.
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last Updated" date and will apply to orders placed and use of the Site after that date. Changes will not apply retroactively to orders you have already placed. Section 18(i) explains how changes to the arbitration agreement work.
22. General Terms
In short: The standard legal fine print, kept short.
- Entire agreement: these Terms, the Privacy Policy, and any terms shown at checkout or on a product page are the entire agreement between you and us about the Site and your purchases.
- Severability: if any provision is unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms stays in effect.
- No waiver: our failure to enforce a provision is not a waiver of it.
- Assignment: you may not transfer your rights under these Terms. We may assign them in connection with a merger or sale of our business.
- Events beyond our control: we are not responsible for delays caused by events beyond our reasonable control, such as severe weather, carrier disruptions, or supplier shortages. If we cannot ship your order within a reasonable time, you may cancel for a full refund.
- Survival: sections that by their nature should survive (such as Sections 9, 10, 12, and 16 through 19) survive after your use of the Site ends.
